On Thursday, November 21, 2019, the Shkawbewisag Student Law Society will be participating in an International Walk-Out to stand in solidarity with the Indigenous people of the Cauca Valley in Colombia. We call for a school-wide Walk-Out to gather and lay tobacco at the riverfront of California Ave and Riverside Ave from 11am-12pm. The event is open to everyone.
On October 29, 2019, Governor Cristina Bautista Taquinas and 4 unarmed Indigenous Guards of the Nasa people in Cauca were killed by illegal armed groups. 56 Indigenous people have been murdered so far this year on Indigenous territories in the area compared with 46 murders for the whole of 2018.
Luis Fernando Arias and Armando Valbueno of the National Indigenous Organization of Colombia (ONIC), as well as other Indigenous Colombian leaders, insist that the government must implement the 2016 peace deal with the FARC to end what they call a genocide. To add pressure, the ONIC announced that all indigenous organizations would join a national strike on November 21.

  “From this liberated space, today we say that as indigenous communities, we find ourselves in assembly and on maximum alert to defend and care for our territory. We hope to count on the peoples of the world in their solidarity and their rejection of these actions,”-Jose, Nasa man.

Coup d’Continent 
The coup d’Etat in Bolivia is an extrapolation and extenuation in today's time of the collapse of the neoliberal project across the planet of the Doctrine of Discovery of Christendom of 1492 and the continuation of 527 years of colonialism and genocide against Indigenous Peoples by the successor states to the doctrine in the Americas.

The coup in Bolivia is the last gasp of the Monroe Doctrine of 1823, the same year that the US Supreme Court under Chief Justice Marshall set the Doctrine of Discovery in the Johnson v. M’Intosh decision as fundamental to all property law in the US system of jurisprudence and jurisdiction. The Monroe Doctrine is the continental extrapolation of the Doctrine of Discovery of Christendom, now being re-invoked in the supranational neoliberal corporate context of the Divine Right of States: OAS Settler States [Americas].

Codified by the doctrine of the Divine Right of States, aka the Westphalian System of State Sovereignty (United Nations) the states of the Americas (OAS) have presented themselves to the international community as immune to the requirement under international law to rectify the Crime Against Humanity of colonialism as mandated in UN General Assembly Resolution 1514 ((1960): "All peoples have the right to self-determination."

UN Declaration on the Rights of Indigenous Peoples (2007): "Indigenous Peoples, equal to all other peoples.....have the right to self-determination."

Instead, the continental settler state schema which is known in Latin America as the "Estado Criollo", lurches deeper into genocide via Bolsonaro in Brazil and Camacho in Bolivia, in alignment with the agenda of the White Christian Evangelical leadership that directs the movement from the pulpits of public power that support Donald Trump in the north.

In this geopolitical schema, the electoral systems of the states, "democratic" or not, are marketing mechanisms, they represent the commodification of constituencies to be manipulated, managed, and eventually bought and sold in order to serve the interests of the cultural and economic elites that will use any means necessary to hold on to the reins of power derived from the continental Coup d'Continent of "White Supremacy"="Christian Domination" that began on October 12, 1492.

White Supremacy and the Doctrine of Discovery

The declaration of DOMINION over territory, a prerequisite in the Westphalian System of International Law (1648) wherein the Sovereign State serves as the matrix of geopolitical power relationships among the elites, still functions in the form of what is now called the United Nations System, a global system of governance whose membership is comprised of mutually recognized government states exercising state sovereignty.

In Mexico the normalization and institutionalization of the Doctrine of Discovery which began with the Vice Royalty of New Spain was continued in the formation of the Mexican Constitution of 1917, where the dogma of the Alexandrian Bulls is reaffirmed in supremacy over the territorial rights of the Indigenous Peoples. In the US legal system, the same effect was achieved in 1823 with the US Supreme Court decision Johnson v. M’Intosh (1823). With the Monroe Doctrine, also in 1823, the geopolitical schema of supremacy codified in the Doctrine of Discovery of Christendom was extended across the continent, with the distinction that no longer would the Royal Families of Christendom be controlling the implementation and perpetuation of the doctrine, from then on the power of hegemony over the hemisphere would shift to Washington, DC and Uncle Sam.

UN Preliminary Study on the Doctrine of Discovery


This preliminary study establishes that the Doctrine of Discovery has been institutionalized in law and policy, on national and international levels, and lies at the root of the violations of indigenous peoples’ human rights, both individual and collective. This has resulted in State claims to and the mass appropriation of the lands, territories and resources of indigenous peoples. Both the Doctrine of Discovery and a holistic structure that we term the Framework of Dominance have resulted in centuries of virtually unlimited resource extraction from the traditional territories of indigenous peoples. This, in turn, has resulted in the dispossession and impoverishment of indigenous peoples, and the host of problems that they face today on a daily basis.



 
Colonization matters, it is not only illegal but if the future of Humanity is to be realized within a collective and life affirming culture of mutual respect for the natural world which we share equally in responsibility, the DOGMA of DOMINION which gave birth to the concept as a norm of “civilized man” aka the “White Man’s Burden” must be challenged and dismantled. Regurgitated by the institutionalized racism of the settler states of America and sanctified by the dogma of cultural supremacy of European American Christendom, the “chosen people” of the “City on the Hill” are called to continue to play out their role as minions of nefarious Doctrine of Discovery. 

The insidious nature of the pogrom extends to the point where even the colonizing construct of “Latin America” has subverted the self determination and Nationhood of Original Nations Abya Yala by the Genizaro Republics of the Americas and their radical ideologues of both the right and left of the Game of Thrones: The concept of State Sovereignty via Westphalia 1648. 
We declare our INTERDEPENDENCE and Solidarity as Peoples of Mother Earth and call for the recognition, respect, and protection for the particular and integral constituencies of our Peoples of Mother Earth as represented in our responsibilities to the Watersheds, the Earth:Waters and Single Sea (hydrosphere) of the planet, beyond the disjointed and corrupt constraints of the Westphalian System of State Sovereignty represented in the UN system and the present international architectures of personality and procedures of negotiation and agreements;

Victims of the Salvadoran war return to Congress to reject the amnesty law

A group of victims of the war in El Salvador (1980-1992) was registered this Thursday by expressing their rejection of a possible new amnesty, presented under the name of reconciliation law in front of the Legislative Assembly in San Salvador (El Salvador)

A group of victims of the war in El Salvador (1980-1992) returned this Thursday to the Legislature to rule against a possible new amnesty under the name of the reconciliation law, whose analysis is stalled. The protesters, mostly mothers of disappeared and killed during the armed conflict, held a second session at the headquarters of the Legislature, where the plenary session for this week is held.

Jose Lazo, a member of the Management Group for a Law for the Comprehensive Reparation of Victims of War, told EFE that the victims "will not get tired of asking for justice and the truth to be told, so they will be here ( in the Legislative Assembly) every day a plenary session is convened. "

Lazo regretted that the group of victims was initially denied entry to Congress and denounced that "this act is part of the actions that an oppressing State does with its citizens, especially with those who cry out for justice."

"The contempt with which this State treats the victims of war is immoral (...) the State and its different bodies must meet the demands of the victims and not disregard the sentence of the highest court (of the country}, the Constitutional Chamber, "he said.

On July 13, 2016, the Constitutional declared the 1993 amnesty law unconstitutional for being "contrary to the right of access to justice, judicial protection or protection of fundamental rights and the right to comprehensive reparation for victims".

The Supreme Court ordered the deputies of the Congress, in the ruling that annulled the amnesty, to create a new legislation focused on the reparation of the victims.

On May 23, deputies halted the approval of a controversial proposed "national reconciliation" law to listen to victims after receiving criticism from various sectors, including the UN.

On Wednesday, about thirty social organizations in El Salvador declared themselves "alert" for the presentation and discussion in Congress of a new bill that seeks to amnest war crimes and crimes against humanity perpetrated during the war.

According to the activists, deputy Roberto Angulo, of the right-wing National Concertation Party (PCN), presented the aforementioned proposal on October 14.

Angulo is considered the main promoter of an amnesty law passed in 1993 that prevented investigating and prosecuting the military and guerrillas linked to war crimes.

The Justice of the Central American country could only reopen cases, such as the murder of San 6 scar Romero (1980) and the massacre of some 1,000 peasants in El Mozote (1981), after the annulment of the amnesty due to the ruling of the Constitutional Chamber.

Un grupo de víctimas de la guerra de El Salvador (1980-1992) fue registrado este jueves al manifestar su rechazo a una posible nueva amnistía, presentada bajo el nombre de ley de reconciliación, frente a la Asamblea Legislativa en San Salvador (El Salvador).

Un grupo de víctimas de la guerra de El Salvador (1980-1992) volvieron este jueves a la Asamblea Legislativa para pronunciarse en contra de una posible nueva amnistía bajo el nombre de ley de reconciliación, cuyo análisis está estancado.

Los manifestantes, en su mayoría madres de desaparecidos y asesinados durante el conflicto armando, realizaron un segundo plantón en la sede del Legislativo, donde se lleva a cabo la sesión plenaria correspondiente a esta semana.

José Lazo, miembro del Grupo Gestor para una Ley de Reparación Integral de Víctimas de la Guerra, señaló a Efe que las víctimas "no se cansarán de pedir que se haga justicia y que se les diga la verdad, por eso van a estar aquí (en la Asamblea Legislativa) todos los días que se convoque a sesión plenaria".

Lazo lamentó que en un principio se le haya negado la entrada al Congreso al grupo de víctimas y denunció que "este acto es parte de las acciones que un Estado opresor hace con sus ciudadanos, es especial con aquellos que claman por justicia".

"El desprecio con el que este Estado trata a las víctimas de la guerra es inmoral (...) el Estado y sus diferentes órganos deben atender las demandas de las víctimas y no desatender la sentencia del más alto tribunal (del país), la Sala de lo Constitucional", manifestó.

El 13 de julio de 2016, el Constitucional declaró inconstitucional la ley de amnistía de 1993 por ser "contraria al derecho de acceso a la justicia, a la tutela judicial o protección de los derechos fundamentales y al derecho a la reparación integral de las víctimas".

El Supremo ordenó a los diputados del Congreso, en el fallo que anuló la amnistía, crear una nueva legislación enfocada en la reparación de las víctimas.

El 23 de mayo pasado, los diputados frenaron la aprobación de una polémica propuesta de ley de "reconciliación nacional" para escuchar a las víctimas tras recibir críticas de diversos sectores, incluida la ONU.

El miércoles, una treintena de organizaciones sociales de El Salvador se han declaro en "alerta" por la presentación y discusión en el Congreso de una nueva propuesta de ley que busca amnistiar los crímenes de guerra y lesa humanidad perpetrados durante la guerra.

De acuerdo con los activistas, el diputado Roberto Angulo, del derechista Partido de Concertación Nacional (PCN), presentó la referida propuesta el pasado 14 de octubre.

Angulo es considerado el principal promotor de una ley de amnistía aprobada en 1993 que impidió investigar y juzgar a los militares y guerrilleros vinculados con crímenes de guerra.

La Justicia del país centroamericano únicamente pudo reabrir casos, como el magnicidio de san Óscar Romero (1980) y la masacre de unos 1.000 campesinos en El Mozote (1981), tras la anulación de la amnistía por el fallo de la Sala de lo Constitucional.
