The Independencia Aqueduct operates illegally and causes irreversible damage to the Yaqui Nation, according to traditional authorities of the Yaqui Tribe during the Festival of Existence held in the town of Estación Vícam, [Sonora, Mexico].  Among the supporters of the traditional authorities who participated in the Festival of Existence included the organization Indigenous Peoples Rights International (IPRI).

 

The traditional authorities also demanded that the Mexican federal government include the cancellation of the Independence aqueduct in the “Justice Plan for the Yaqui Tribe” being promoted under the administration of current Mexican president Andres Manuel Lopez Obrador (AMLO).

 



With exhibitions, music, dance, paintings, cinema and conversations, the Yaqui tribe expressed their rejection of the operation of the Independencia Aqueduct, which was built without informing or consulting the Indigenous Peoples, and which has caused damage to ancestral Yaqui sites in the territory, causing obstructions to Yaqui ceremonial ritual practices and desecrations in the worldview of the Yoeme (Yaqui).


The Yaqui Sewa Tomteme school hosted the meeting in Vicam, with in-person invited guests and other individuals connected through digital platforms such as the engineer Cuauhtémoc Cárdenas Solorzano, as a special guest.


During his presentation in the Festival of Existence, which was promoted by live stream across the internet, Cuauhtémoc Cárdenas Solorzano exhorted respect for the presidential decrees established between the federal government and the Yaqui Tribe in 1937 and 1940 by his father, then President Lazaro Cardenas, and to cancel the operation of the Independencia aqueduct. He also called for justice and accountability for the murders of indigenous leaders in Sonora over last six months.


“It is essential that the provisions of the 1940 decree be respected in order to fully restitute the Yaqui territorial rights, but above all so that the Yaquis can manage and dispose of the water rights which they legitimately possess, specifically 50 percent of the volumes of water from the Rio Yaqui stored in the Angostura dam. I believe the cancellation of the so-called Independencia aqueduct is essential, as I said a few days ago before current Mexican president AMLO, not only because the Aquaducto Independencia project was constructed in violation of established legal provisions, but also because these violations of law have been allowed impunity with the complicity of government authorities,” said Cárdenas Solorzano.


Mario Luna Romero, spokesman for the Yaqui tribe, pointed out as unforgivable that neither the National Institute for Indigenous Peoples (INPI), nor the Federal Government included in the recently announced Justice Plan for the Yaqui Tribe, the cancellation of the Independencia aqueduct, after the Yaqui have dedicated enormous efforts in their struggle to defend the Rio Yaqui over recent years.  He gave as evidence to this struggle the many resolutions and judicial orders affirming the demands by the Yaqui including from the Supreme Court of Justice for the Nation and the United Nations that have been ignored by the federal government.



“Within the Yaqui tribe, decisions are made by consensus, in the plaza of the Traditional Guard where everyone participates, and this absence of a culturally appropriate decision-making is what has prevented the Yaqui Justice Plan from progressing and having better results.  That is why it has had serious omissions such as the fight for the defense of the Yaqui River, which has been excluded from the plan due to pressure from economic interests and the abuse of power that does not contribute to the unity of the Yaqui tribe”, stated Mario Luna, who was a political prisoner during the administration of Guillermo Padrés for opposing the Aquaducto Independencia.

Aucan Huilcman: Mexico and Chile - Presidential Requests for Pardon "Without Effect"

MEXICAN PRESIDENT ANDRES LOPEZ'S REQUEST FOR FORGIVENESS AND EXPRESIDENT MICHELLE BACHELET'S REQUEST FOR FORGIVENESS IN CHILE: VERY SIMILAR AND WITHOUT EFFECT.

The recent request for pardon expressed by the President of Mexico, Andrés Manuel López Obrador AMLO, before the Yaqui Tribe in Sonora is very similar to the same request for forgiveness of former President Michelle Bachelet in Chile.  Both events, although being very relevant in terms of the human rights of Indigenous Peoples, yet in the manner that these official acts have been publicly presented neither of the requests bring bear any effectiveness from which a true forgiveness may be derived. Such authentic petitions for pardon by the heads of state in the Americas to the Indigenous Peoples would include directives towards restoring justice, reparations and a just and equitable compensation for the historical trauma caused in all its forms.

 

The issue of merit, the earning of pardon and then forgiveness - remains undefined and is not addressed.  This refers to the fact that AMLO has now dared to ask for pardon in his visit to the Yaqui People, which of course has now caused a reaction at various levels, among them in the government of Spain and even the King of Spain.  However, all of these reactions are unavoidably related to the context of the current situation that Indigenous Peoples are living in Mexico, Peru, Argentina, Guatemala, and Chile and across the continent where other countries continue to deny the institutional responsibility for their policies and genocidal practices towards the Original Nations of Indigenous Peoples over the past 500 years.

 

In the act of requesting forgiveness from the Indigenous Peoples by both leaders, Michelle Bachelet in 2017 and now the president of Mexico, shows that there are pending issues with Indigenous Peoples in the hemisphere, both in the context of issues that originate with the Hispanic colonial relations and subsequently with the formation of the National States, whether in Argentina, Chile, Peru, Mexico, and others. The pending issues are related to the "International Crime of Genocide" which remains in complete impunity until today.

With the formation of the nation states, the invasion, and dispossession, and occupation of the indigenous territories and their resources became normalized and then institutionalized, without the consent of the Indigenous Peoples, as established in Article 28 of the United Nations Declaration on the Rights of the Indigenous Peoples of the World (2007).

An legitimate pardon is commonly the result of a process of clarification of certain controversial facts that motivate a head of state to ask for forgiveness, however, in the case of AMLO and Michelle Bachelet, the facts related to both pardon requests are characterized as not producing the effects of an honest and effective process for forgiveness to be actually received.  Instead, the public posturing by both presidents of state have typified of an incomplete acknowledgement of historical truth relative to the treatment of Indigenous Peoples, that is, a comprehensive clarification of the facts that would necessarily provide the basis for an authentic forgiveness is lacking.

 

Secondly, a public policy of reparations and a fair and equitable compensation must direct the manifestation of the procedures for a legitimate pardon. A pardon in terms of human rights is intrinsically related to a policy of justice and reparation for the damage caused, which does has not occurred in the petitions for forgiveness of AMLO and Michelle Bachelet.

 

In the case of former president of Chile, Bachelet, it was a request for pardon orchestrated for purposes of international posturing, allowing her to constitute a precedent in her favor for the achievement of the post of High Commissioner for Human Rights at the United Nations, by giving the impression of a person committed to human rights of the Indigenous Peoples. In short, the request for pardon was an eloquent use of political theater, despite the seriousness of the criminal acts that have been committed against the Mapuche people and which remain in complete impunity.

 

In the case of Chile, the situation of injustice that Indigenous Peoples and especially the Mapuche have experienced, has not only been used by former President Bachelet, but, now recently, by the political parties of one side or the other.  These political schemes have resorted to usurping the legitimate Mapuche cause of self-determination to clothe themselves and deploy a strategy to coopt the indigenous political movement in order to maintain power, as has happened in the Constitutional Convention of the Chilean People this year.

 

The injustices related to the Indigenous Peoples is also similar to the Peoples of Africa who were subjected to the system of human slavery in the past. Despite the lapse of time, the issues related to human slavery had an open demonstration at the World Conference Against Racism and Xenophobia and other Related Situations in Durban, South Africa 2001.

In Durban, the governments and the Peoples of Africa raised the issue to the governments of the world that human slavery constituted a "Crime Against Humanity". This principle was preliminarily accepted by the States of the world, which included the States of Europe that were primarily responsible for the slave trade from Africa. However, among the political actors who invoked the need to codify slavery as an international crime, there were those who also created a dilemma by calling for the development of "a long process of dialogue in the multilateral international system to codify "slavery" as a "Crime Against Humanity". Meanwhile the public processes for the requested pardons for the historical crimes of colonization continued and evidently then prevailed, so that the act and procedures of public petition for pardon overtook the process of codification of the crimes for which the pardon was needed in the first place.


The value of a request for forgiveness and pardon is that it constitutes a gradual overcoming of denialism and that has become unsustainable over time. The centuries-long policy of denial of Human Rights has not only hurt Indigenous Peoples, but also all Peoples of the continent and the world.


Some organizations of the Indigenous Peoples, as a result of the participation of the Catholic Church in the process of European colonization of the continent Abya Yala/Wallmapuche, have raised the responsibility of the Vatican as a state to address the need to go beyond asking for a simple pardon, but rather, assume the full institutional responsibility of complicity in the context of international law. This institutional responsibility as a member state in the UN system, emerges from the the context of the "doctrine of Discovery of Christendom", from which the current situation of indigenous peoples is derived.


It is not the case that the relevant efforts of a public policy with the Indigenous Peoples in Mexico and Chile go unrecognized, but this is another matter that is not related to a policy of fair, impartial and equitable reparations in matters of human rights regarding events of the past that continue as issues of colonialism in the present.


The request for forgiveness of Michelle Bachelet and the request for pardon of AMLO, augurs new times, that is, these petitions for pardon represents a preliminary stage of the responsibility of the Latin American States, which now depends to a large extent on the articulation among the Indigenous Peoples to bring the of enforcement to the next stage.  This would entail the comprehensive clarification of the factual record, demanding reparations and compensation in a fair and equitable manner for the damage caused by centuries of colonization and establish the institutional measures for a firm and lasting coexistence in the continent under the rule of law and the principle of self-determination.

Mensaje a los hermanos Yaquis,

 

En primer lugar, reitero la hermandad entre Yaquis y Mayas, pueblos que enfrentaron y resistieron las arremetidas del colonialismo, de la esclavitud y del exterminio impuestos por el Estado Mexicano. Sin gastar muchas palabras señalo que las ceremonias de petición de perdón por agravios cometidos contra nuestros pueblos son más palabras que compromisos reales. 

 

Seguramente habrá quienes vean estas acciones con esperanza y muchos otros con desconfianza, pues la historia nos ha enseñado que hay que desconfiar de los gobiernos pues en esencia son los mismos que en el siglo XIX imponían el naciente capitalismo y que ahora imponen el neoliberalismo anti indígena y destructor de nuestros territorios.

 


Y es que no puede haber perdón ni desagravio por lo sufrido en el pasado sino se toma en cuenta los graves problemas y agravios que se cometen en el presente. Solo por mencionar algunos: el acueducto en territorio Yaqui y el tren de la 4T en territorio Maya. No es posible perdonar sin que se atienda y resuelva el problema de los desaparecidos, muertos y presos políticos. Tampoco cuando se trata como invasores a los habitantes de pueblos que quedan en el trayecto del tren y se pretenden expulsarlos, cuando existe violencia e inseguridad en nuestros pueblos. 

 

No hay que despreciar toda la política pública del gobierno mexicano dirigida a los Pueblos Indígenas, pero si hay que dejar claro que mientras no exista y no se aplique una política de reparación, justa imparcial y equitativa en materias de derechos humanos sobre hechos del pasado que siguen siendo asuntos del presente, no podemos creer en estas ceremonias de petición de perdón.

 


Es tiempo de la rearticulación en nuestros Pueblos Indígenas y es importante su coordinación para esclarecer tantos hechos que han sido interpretados a conveniencia de élites económicas y políticas en una historia oficial; es época de exigir la reparación de manera justa y equitativa al daño que por siglos nos causaron los invasores y establecer con el Estado, mediante dialogo con equidad, las medidas institucionales que permitan la convivencia con respeto al derecho y principio de libre determinación de los Pueblos.

 

Ojalá logremos que sea así y no terminemos confiados aceptando proyectos y condiciones del Estado mexicano. Hay sabiduría ancestral y una enorme bolsa de derechos conquistados con muchos años de lucha que debemos usar de manera pertinente, a nuestro favor como Pueblos Originarios.

Chile y México: Peticiones de Perdón Presidencial a los Pueblos Indígenas

PERDON DEL PRESIDENTE ANDRES LOPEZ EN MEXICO Y EL PERDON DE MICHELLE BACHELET EN CHILE:
MUY SIMILARES Y SIN EFECTO

El perdón que ha manifestado el Presidente de México, Andrés Manuel López Obrador AMLO, tiene mucha similitud con el perdón de la expresidenta Michelle Bachelet en Chile. Ambos hechos tan relevantes en materia de derechos humanos y tal como se han hecho, no tienen ningún efecto del cual se deriva un verdadero perdón, orientado a restablecer la justicia, la reparación e indemnización justa y equitativa al daño causado en todas sus formas.


El mérito se refiere a que se haya atrevido a pedir perdón en su visita al Pueblo Yaqui y por su puesto ha causado reacción en diversos niveles, entre ellos en el gobierno de España y el Rey de España, sin embargo, todos ellos, tienen relación con la actual situación que viven los Pueblos Indígenas sea en México, Perú, Argentina, Guatemala o Chile. entre otros países y han omitido su responsabilidad institucional.

El acto de manifestar el perdón de los mandatarios tanto, de Michelle Bachelet, en el año 2017 y ahora el presidente de México, pone de manifiesto que hay temas pendientes con los Pueblos indígenas en el hemisferio, tanto, en aquellos que se originan en las relaciones coloniales hispana y con la formación de los Estados Nacionales, sea en Argentina, Chile, Perú, México y otros. Los temas pendientes dicen relación con el “Delito de Genocidio” y que permanecen en completa impunidad hasta el momento y en la posterior formación de los Estados nacionales en donde se materializó la toma y ocupación de los territorios y sus recursos, sin el consentimiento de los Pueblos Indígenas, tal como lo establece el artículo 28  de la Declaración de Naciones Unidas sobre los Derechos de losPueblos Indígenas del Mundo.

 


El perdón comúnmente es el resultado de un esclarecimiento de determinados hechos controversiales que motivan a un jefe de Estado a pedir perdón, sin embargo, en el caso de AMLO y Michelle Bachelet ambos hechos relativos al perdón se caracterizan que no producen los efectos de un verdadero y efectivo perdón, es más propio de un acto incompleto sobre la verdad histórica con los Pueblos Indígenas, es decir, la falta de esclarecimiento de los hechos que fundan el perdón y en segundo lugar, una política de resarcimiento e indemnización justa y equitativa como causa de la manifestación del perdón.

El perdón en materia de derechos humanos, esta intrínsecamente relacionado con una política de justicia y reparación al daño causado, lo que no ocurre en el perdón de AMLO y ni de Michelle Bachelet.

En el caso de la expresidenta Bachelet, fue un perdón para los propósitos internacionales y constituir un antecedente a su favor para la consecución del puesto de Alta Comisionada para los Derechos Humanos en Naciones Unidas, así daría la impresión de una persona comprometida con los derechos humanos de los Pueblos Indígenas. En definitiva el perdón fue una elocuente utilización política, a pesar de la gravedad de los hechos que se ha cometido con el Pueblo Mapuche y que permanecen en la completa impunidad.

En el caso de Chile, la situación de injusticia que han vivido los Pueblos Indígenas y en especial los Mapuche, no tan solo ha sido usado por la expresidenta Bachelet, sino, ahora recientemente por los partidos políticos de un bando u otro, han recurrido a la legitima causa Mapuche para arroparse y desplegar su estrategia para la mantención en el poder, como sucede en la Convención Constitucional del Pueblo Chileno.

La situación de injusticia con los Pueblos Indígenas también tiene similitud con los Pueblos de África que fueron objeto del sistema de esclavitud en el pasado. Los asuntos relativos a la esclavitud a pesar del tiempo transcurrido, tuvieron una abierta manifestación en la Conferencia Mundial en Contra del Racismo y la Xenofobia y otras Situaciones Conexas allí en Durban 2001.

Los gobiernos y los Pueblos del África plantearon a los gobiernos del mundo que la esclavitud constituía un “Crimen de Lesa Humanidad”. Este principio preliminarmente fue aceptado por los Estados del mundo, lo que incluye los propios Estados preferentemente de Europa que practicaron la Esclavitud, sin embargo, los que invocaban la necesidad de tipificar la esclavitud, lo pusieron en una encrucijada y se le dijo “desarrollamos un largo proceso de dialogo en el sistema multilateral para tipificar el “la esclavitud” como un “Delito de Lesa Humanidad” o seguimos tramitando el crédito que ustedes han solicitado y evidentemente prevaleció lo último, es decir, el crédito.

Lo valioso del Perdón que, constituye una superación gradual del negacionismo y que se hace insostenible en el tiempo. La política de siglos del negacionismo no tan solo le ha hecho un daño a los Pueblos Indígenas, sino, también a todos los Pueblos del continente y del mundo.

Algunas organizaciones de los Pueblos Indígenas, a raíz de la participación de la Iglesia Católica en el proceso de colonización Europea al continente Abya Yala /Wallmapuche, han planteado la responsabilidad del Vaticano y que va más allá de pedir un simple perdón, sino, asumir su responsabilidad institucional Estatal, en el contexto de la “doctrina del descubrimiento”, en donde se deriva la actual situación de los Pueblos indígenas.




En ningún caso se desconoce los esfuerzos de una política pública con los Pueblos Indígenas tanto en México y Chile, pero eso es otro asunto que no dice relación con una política de reparación, justa imparcial y equitativa en materias de derechos humanos sobre hechos del pasado y que siguen siendo asuntos del presente.

El perdón de Michelle Bachelet y el Perdón de AMLO, augura nuevos tiempos, es decir, ese perdón que representa una etapa preliminar de la responsabilidad de los Estados Latinoamericano, ahora depende en gran medida de la articulación entre los Pueblos Indígenas para hacer cumplir la otra etapa, es decir, el esclarecimiento de los hechos, exigir la reparación e indemnización de manera justa y equitativa al daño causado por siglos y establecer las medidas institucionales para una convivencia firme y duradera en el continente bajo el derecho y el principio de la libre determinación.

Con la intención de abordar las cuestiones de violaciones de Derechos Humanos, en particular el derecho a la autodeterminación de los Pueblos Indígenas, con el fin de instituir  medidas correctivas colectivas en el rechazo de la Doctrina del Descubrimiento, ya que la Doctrina continúa sirviendo como una manta de camuflaje para la patología y para la colonización que deforma y viola el espíritu y el bienestar de nuestra Humanidad Común;

Nuestra posición es que el Estado del Vaticano, la Santa Sede y Su Santidad el Papa Francisco deberán tomar las medidas adecuadas y llevar adelante un proceso de responsabilidad internacional por el papel que la Iglesia Católica ha jugado en el origen y autoría intelectual de las violaciones de Derechos Humanos que siguen siendo normalizadas por la Doctrina del Descubrimiento.  Exhortamos Su Santidad a hacer comentario público en repudiación de la Doctrina del Descubrimiento y en clarificación de las contradicciones aquí documentadas.

49.  It follows that the issue of treaties affecting indigenous peoples as third parties may continue to be relevant insofar as they remain in force and insofar as indigenous peoples already participate - or may in the future - in the implementation of their provisions.  Among the 10 instruments previously considered for analysis, 18  apart from the Lapp Codicil, several others would warrant further scrutiny, among them the 1794 Jay Treaty and the 1848 Treaty of Guadalupe-Hidalgo, both of apparent special significance for the indigenous nations along the borders of the United States with Canada and Mexico respectively.

322.  Finally, in connection with the indigenous affairs related activities of the Office of the United Nations High Commissioner for Human Rights, the Special Rapporteur recommends:


(b)  The establishment, at the earliest possible date, of a section within the United Nations Treaty Registry with responsibility for locating, compiling, registering, numbering and publishing all treaties concluded between indigenous peoples and States.  Due attention should be given in this endeavour to securing access to the indigenous oral version of the instruments in question;

Revisiting the 1863 Ruby Valley Treaty of Peace & Friendship Gathering

As operating Secretariat of the Continental Commission Abya Yala, we are particularly interested in the position of the US government in the case where they purport to claim the right to extinguish Shoshone land title by way of "gradual encroachment" of the Ancestral Territories of the Western Shoshone based upon the legaloid and "nefarious" tenets of the Doctrine of Discovery of Christendom.


“The United States claims that the title to the land in question was ceded to the United States by Mexico in 1848, subject to occupancy by the Native Americans. The United States maintains that in 1863, it signed a treaty with the Western Shoshone, referred to as the Treaty of Ruby Valley, and that under the Treaty the United States and the Western Shoshones agreed to end hostilities between them and live amicably. The United States claims that subsequent to the treaty with the Western Shoshones it treated certain lands within the area at issue as lands of the United States.”


Although the US government had announced its intention to recognize the independence of the Spanish-American colonies in 1822, Spain did not recognize Mexico's independence until the Santa María–Calatrava Treaty of December 28, 1836. This was the first case in which the Spanish monarchy acknowledged the independence of a state that had been erected within the limits of her former colonial empire in the New World."


Under the terms of the Santa María–Calatrava Treaty of December 28, 1836 the dominions of Mexico were to be comprised of the former Viceroyalty of New Spain, the captaincy-general of Yucatan, the commandancies of the eastern and the western interior provinces, lower and upper California, along with the annexed territories and adjacent islands. The source of the original purported territorial claim by the Viceroyalty of New Spain in Mexico which was transferred to the Mexico was the royal charters given to Columbus by the monarchy of Spain in 1492 and affirmed from the pinnacle of the imperial structure of Christendom (the Vatican) by Pope Alexander VI via the Papal Bull Inter Caetera of 1493.

As we have now engaged the Tom Lantos Human Rights Commission in a public dialogue intended to promote the recognition, respect and guarantees for the Human Rights of Indigenous Peoples, we submit this report to the IACHR mindful of the lack of substantive response by the US government to your request of August 18, 2020 to the US Department of State regarding the case of our dear Shoshone relatives, Mary and Carrie Dann.

We submit here these principles for consideration in the Western Shoshone case going forward with the intent to connect principle with action, recognition with mutual respect, and humanity with the Territorial Integrity of Mother Earth.
