Principles and Purpose

In realization of the urgency for definitive action based on our mutually shared prerogatives as Indigenous Peoples of Mother Earth, which include the Human Rights of the Future Generations, and in affirmation of our equally shared Ancestral Interdependence and Responsibilities to Mother Earth as kindred Original Nations of Indigenous Peoples across the planet, we send a message of Resistance, Rebellion, and Regeneration to the conscience of Humanity in full exercise of our International Personality as Original Nations of the Great Turtle Island Abya Yala to PROCLAIM from the International Spiritual Monument at Standing Rock:

The fight to stop the Dakota Access Pipeline (DAPL) at Standing Rock has brought forward to the conscience of the world the need to protect the watershed of the Missouri River as primary source of water for the Standing Rock Sioux Tribe and all other downstream constituencies.  The reality is that the monumental fight to stop the Dakota Access Pipeline Project (DAPL) from crossing the Missouri is emblematic of the fight of all Humanity to escape the planetary empire of PETROPOLIS, the global fossil fuel corporate consortia and their accomplices in government and the media who have conspired to place the agenda and financial interests of their neo-liberal capitalist regime over the Human Rights of the future generations and the well-being of Mother Earth.


As Original Nations of Indigenous Peoples with Treaty Standing with the US government and before the International Community, we stand together at Standing Rock to affirm that the fight to Protect the Sacred Waters of the Missouri River is ultimately and originally tied the fight of our Nations to exercise our Right of Self Determination as "Peoples, Equal to all other peoples...." as Water Protector Nations of Mother Earth.

Beyond the environmental concerns and issues which may (or may not) be addressed in an Environmental Impact Statement to be evaluated under the domestic regulations of the US Department Environmental Protection, the fact is that the Dakota Access Pipeline NEVER acquired the Free, Prior and Informed Consent of the Oceti Sakowin Dakota-Nakota-Lakota Nations and other Original Nations whose traditional territories are to be impacted by the DAPL petroleum pipeline, which was originally known as the Bakken Pipeline.


The lack of Free, Prior, and Informed Consent for the DAPL project is not only a violation of Due Process and the principles inscribed in the UN Declaration on the Rights of Indigenous Peoples (2007), it is a financial liability that must be addressed in the account ledgers of the parent company Energy Partners as such and before all relevant financial institutions and international credit agencies.

We reaffirm here once again, being that conflict at Standing Rock is occurring within the Treaty Territories of the 1851 and 1868 Fort Laramie Treaty with the US government, the International Community must support the establishment of a distinct international body to address treaty disputes between Nations of Indigenous Peoples of Mother Earth and the Government States of the UN system. This was a fundamental finding of the Final Report to the UN by Dr. Miguel Alfonso Martinez in 1999, in his Study on treaties, agreements and other constructive arrangements which was a Final Outcome Document produced by the Uprising at Wounded Knee in 1973. The Uprising at Wounded Knee in ’73 presented the very same treaty arguments to the world community at the UN which are now be brought forward once again at Standing Rock in 2017, now 44 years later.

The source of the crude oil to be shipped via the DAPL derives its source from the ecological and genocidal nightmare scenario that is the Bakken fracking fields in Montana, where the expansion of refinery operations powered by proposed "small" commercial nuclear reactors in Idaho threaten to drive the "Bakken Frackenstein Project" permanently and irretrievably into a scenario of regional ecocide along the way to the abyss of planetary TERRACIDE.

The fight at Standing Rock is not only about one pipeline crossing one river in a continuum of the centuries long genocidal pogrom against the Original Nations, it is the last chance for America to save its soul.  It is the emblematic fight of our generation to take a stand for our common humanity and in good relations with all our relatives of the Natural World take collective action to escape the catastrophic effects of the carbon emissions into the atmosphere that derive from the fossil fuel corporate empire and the policies of the states that have brought us all into the horizon of global Climate Chaos.


Cochabamba Protocols

Invoking the principles of the Cochabamba Protocols as Original Nations of Mother Earth which emerged from the World Conference on Climate Change and the Rights of Mother Earth (2010) in Cochabamba, Bolivia, we advance in our global movement to Defend the Territories and Protect the Waters of our Sacred Mother Earth with the following clarifications:

•          The architectures of the States and their Agreements are insufficient, incompetent, and unrepresentative of our political will and our self determination as Peoples of Mother Earth to address the systemic causes of climate change with the necessary holistic and equitable approach that is necessary to avoid ecosystem collapse and TERRACIDE.
 

•          As Peoples of Mother Earth, we collectively determine to regenerate our relationships among ourselves within a Cultural Climate of Mutual Respect, Inclusion, Complementarity, and Self Determination beyond the existing constrains of the international systems of state sovereignty and in responsibility to the well being of the future generations;

•          Recognizing that unless this fundamental dimension of international relationships among human societies at the planetary level is first recognized, established and affirmed, there will be no sustainable progress in addressing effectively and in timely manner the Climate Chaos scenario that now befalls all of Humanity due to the impacts on global climate exacerbated by greenhouse gas emissions of consumer society, extractive industries, and  in particular the global fossil fuel consortia of Petropolis in complicity with national government states and existing international monetary systems and institutions.

From the International Spiritual Monument at Standing Rock, today we proclaim and hereby reaffirm in collective Responsibility as Peoples of Mother Earth, in Equality with all Peoples, our collective Right of Representation and Self Determination in addressing the issues of Climate Change beyond the constraints of the architecture of the States and their agreements;

We further affirm and proclaim in Full, Effective, and Complete exercise of our equally shared Right of Self Determination as Peoples of Mother Earth, that our Sacred Mother Earth is subject of the Right of Self Determination beyond the limited juridical constraints of the Westphalian System of State Sovereignty represented in UN system and the international architectures of personality and procedures of negotiation and agreements;


Therefore:

In fulfillment of our shared mandate of responsibilities to the Future Generations and taking DIRECT ACTION to realize the DECOLONIZATION of MOTHER EARTH,

From the International Spiritual Monument at Standing Rock, we now reaffirm our Ancestral Interdependence and Responsibilities to Mother Earth as kindred Original Nations of Indigenous Peoples in Continental Alliance established by the Treaty of Teotihuacan 2000.

We call for the recognition, respect, and protection for the particular and integral constituencies of our Peoples of Mother Earth as represented in our responsibilities to the Watersheds of the Waters of Life: the Earth:Waters and Single Sea (hydrosphere) of the planet, beyond the disjointed and corrupt constraints of the Westphalian System of State Sovereignty represented in the UN system and the present international architectures of personality and procedures of negotiation and agreements.

We PROCLAIM our nationhood as Water Protector Nations of World Water One: Water is Life.

Such principles of Recognition, Respect and Protection to then be instituted to address the corollary ecological responsibilities as inscribed in the climate issues of the inter-relationships of the Wind:Sun, namely Mother Earth's atmospheric and planetary energetic systems, both natural and technological, including greenhouse gas emissions.


In furtherance of which we affirm and now proclaim our mutual commitment to defend and protect the Territorial Integrity of Mother Earth as a fundamental tenet of International Law which integrates the Right of Self Determination of the Nations of Indigenous Peoples to intervene in the defense of Mother Earth and to take necessary corrective action in exercise of the right of Free, Prior and Informed Consent in defense of their territories and nations.

It deserves noting, that while Dr. Martinez called for the establishment of a distinct international body back in 1999 to address treaty disputes between Nations of Indigenous Peoples of Mother Earth and the Government States of the UN system, that was nine years before the UN itself adopted the Declaration on the Rights of Indigenous Peoples (2007) which now has unequivocally proclaimed Indigenous Peoples as “Equal to all other peoples…”

As Peoples, equal to all other peoples, our treaties are also equal to all other treaties and thus our traditional systems of International Law, from Jurisgenesis to Jurisprudence, from Jurisdiction to Judgement, must also be integrated without prejudice into the design, implementation, and evaluation systems of contemporary international law. This principle of Equality as Peoples which was not in place as official criteria for evaluation during the Treaty Study by Dr. Martinez, now mandates that the UN treaty study itself be updated and revised appropriately.
 

For example, in the case of the Dakota Access Pipeline, the public narrative has emphasized that because the project does not cross the Medicine Line (aka the US-Canada International Border), there is no need for review under relevant procedures by the US state department and the executive office of the president. This narrative is flawed, in that the violations of International Law on the Traditional Territories of the Oceti Sakowin as referenced in the 1868 Ft. Laramie Treaty which the Dakota Access pipeline is the latest example of criminal conspiracy and US government collusion are prima facia evidence for a hearing before a competent international forum as Dr. Martinez recommended in 1999. The borders of the Treaty Territories have been violated, once again.

Conclusion:

The overarching interests of all parties involved in the conflict at Standing Rock in material and spiritual dimension, in both symmetry and diversity in terms of the cultural constituencies and cosmetric world views engaged, all invoke the universal goal of World Peace.  As was said by the Lakota Holy People, this world of peace begins within, it is an emanation of our shared human reality at the planetary level, not an expression of any deforming and dehumanizing racist doctrine. The goal of world peace lies as a seed in each human heart.

We are called to provide the necessary sustenance for that individual seed of world of peace to be nurtured, protected, and if necessary defended.  This will be our legacy to the future generations.  And as was very clearly stated by representatives of the Original Nations of Indigenous Peoples who participated in the Global Indigenous Preparatory Conference in Alta, Norway 2013 we cannot expect to have peace on earth if we are not at peace with Mother Earth.

To be at peace with Mother Earth requires that human society achieve equilibrium and homeostasis with the natural world. This culture of equilibrium also begins within each of our hearts and souls, in our homes and communities, and is communicated constantly by the ebb and flow of the Sacred Spirit of Water, M’ni Wiconi – In Atzintli, In Nemililiztli.

  1. Very well-done in my estimation. This document ties together a number of critical issues and landscapes in a necessarily radical critique of all that is at stake. At the same time as being broadly universal it attends to local politics of international import in an extensively knowledgeable way.
