Ten years since the First Dismantling the Doctrine of Discovery International Conference held at Arizona State University West on April 19-20, 2013, the Continental Commission Abya Yala will advance into the next cycle of INTENT and ENGAGEMENT towards the objectives and goals of the local-regional, continental-global initiative which has remained active across the continent throughout this most recent chapter of our collective history as Original Nations of Indigenous Peoples of Abya Yala.

 

The continental call to consciousness and courage will be emitted today at dawn during the Tlanexpapalotl (Butterfly Sun) Ceremonies of the Izcalli Abya Yala at dawn. The date corresponds to the spring equinox north of the equator, and the fall equinox in the south which will occur on March 20, 2023.

 

As was the case ten years ago, the call by the Continental Commission Abya Yala is being led by the same three organizations of Indigenous Peoples: Techantit, Vision Maya, and TONATIERRA.

 


Now advancing beyond the initial ten-year phase of the Dismantling of the Doctrine of Discovery of Christendom, the Continental Commission will coordinate and synchronize with ceremonial protocols appropriate to each particular nation and territory, the EMERGENCE and REGENERATION of the Original Nations of Indigenous Peoples of Abya Yala in exercise of an autonomous and interdependent geopolitical continental alliance of Indigenous Self Determination.

 

In the north, the ceremonies will commence at sunrise and go to noon of the Tlanexpapalotl (Spring Equinox) on March 20, 2023.

 

South of the equator, the Original Nations of Indigenous Peoples of Abya Yala will synchronize and coordinate accordingly as they celebrate the Yohualpapalotl (Fall Equinox) in complementarity with the spirit of the Kundur Anka, the Continental Confederation of the Eagle-Condor.

 

 

It was in 1990, during the First Continental Indigenous Encounter in Quito, Ecuador that the seeds of the mandate of the Continental Commission Abya Yala were first collected and planted among the delegations of Indigenous Peoples who came to together in that historic event.

 

After the First Encounter in 1990, the Second Continental Encounter took place in Temoaya, Mexico in 1993.  Subsequently, there have been five continental indigenous Summits:

 

First Continental Indigenous Summit - Teotihuacan, Mexico 2000

Second Continental Indigenous Summit - Quito, Ecuador 2004

Third Continental Indigenous Summit – Iximché, Guatemala 2007

Fourth Continental Indigenous Summit – Puno, Peru 2009

Fifth Continental Indigenous Summit – Cauca, Colombia 2013

At the plenary of the Fifth Continental Summit in Colombia in 2013, the decision was made to take the sixth summit to Honduras at the request of Berta Cáceres and COPINH. Due to the assassination of Berta Cáceres in 2016 and the pall of violence and impunity in Honduras against COPINH and other human rights defenders and environmental activists, the trajectory of the continental indigenous movement also was set back, but not deterred. Then came the COVID pandemic of 2019-2021.

 

In response, TONATIERRA traveled twice as emissary and representative of the Continental Commission Abya Yala to Honduras, to propose that the objective of organizing a singular continental summit be modified and reformed as a call for Continental Council instead.  We proposed to continue coordinating our work in continental solidarity and synchronicity, by setting our own agenda with our own calendar systems to convene annually during the Fall and Spring Equinoxes of every year, each Indigenous Nation within their own territory across Abya Yala.

 

This proposal was supported by the elders of the Council of Popular and Indigenous Organizations of Honduras (COPINH) and in 2020 the Izcalli Abya Yala was initiated.

 

Since 2020, in the fall and the spring, these actions of cultural indigenous self-determination at have continued to mature and develop. Now, in 2023, with this foundation, the Izcalli Abya Yala echoes the call of the original Continental Encounter of 1990 in Quito, Ecuador and all of the subsequent summits and diverse initiatives of the Original Nations of Indigenous Peoples to proclaim the Superseding of the Doctrine of Discovery of Christendom as the objective of the next cycle of the work of the Continental Commission Abya Yala.

Superseding the Doctrine of Discovery

 

The world is not flat, it never was.

 

Similarly, the dogma of the geocentric description of the cosmology of Christendom, which was imposed upon its constituents and colonial outposts, has now been abandoned for the fallacies and bias of the cultural hubris of its perpetrators in the hierarchies in power.  The dogma of the geocentric model has been superseded.

 

Abandoning the geocentric doctrine of cosmology, the "Western World" of Christendom moved into a heliocentric description of our solar system.  Yet, as a physical description of interrelationships among spatial bodies of mass in the solar system relative to each other, while the sun does not revolve around the earth - neither does the earth revolve around the sun.

 

Both Sun and Earth, entities of mass and therefore revolution and spiral orbit, revolve around their respective centers of gravity, in barycentric and cosmetric interrelationship within the entire field of gravitational forces, including the vectors of distance, duration, and energy that describes our world in the Universe of the Four Directions: Cemanahuac.

 


The doctrine of a geocentric universe was challenged by Copernicus and eventually superseded by the current “BIG BANG” model, but to challenge the dogma of the Holy Roman Catholic Church in terms cosmology in 1492 was blasphemy punishable by excommunication, torture, and death under the courts of the Inquisition.

 

Today, although the corresponding political dogma of Eurocentric theology known as the Doctrine of Discovery falls in the same category of antiquated and globally  repudiated concepts of cultural supremacy and colonialism as geocentrism, the Doctrine of Discovery remains as the fundamental legal principle that defines all US property law and jurisprudence not only within the courts but the entire legal US legal system of jurisdiction and law enforcement. Internationally, the dogma of the Doctrine of Discovery also perpetuates the norm of 531 years of continental colonialism across the entire continent by the mechanism of the concept of “successor states” to the doctrine that is upheld by each and every “American” state today.

 

This nefarious international policy of impunity in violation of the right of self-determination of the Original Nations of Indigenous Peoples is further reinforced by another discriminatory dogma of contemporary international law known the Blue Water Rule relevant to the right of Self Determination of Indigenous Nations.

 

“The question is no longer whether the Doctrine of Discovery as it is still being perpetuated in policy and practice across the hemisphere is valid. That question has been answered, definitively and finally. There is no moral, legal, or cultural presentation that can legitimately argue that the theory of the Divine Right of Kings, which spawned the Doctrine of Discovery by Christendom, can hold any validity in a democratic society by positing the “Divine Right of States”. What is in question now, is on what side of history will each of us as individuals, as families, as communities, as nations and as Human Beings stand."

CONTEXT


Today, just as there is no valid legal, moral, religious or ethical case to made in defense of the Doctrine of Discovery of Christendom as the theological premise for the continued normalization of the ongoing colonization and genocide of Indigenous Peoples of the Great Turtle Island Abya Yala, operating with purported privileged territorial claims of jurisdiction over Indigenous Nations territories, neither is there a valid presumption to continue to prescribe and officialize the temporal aspects of the regimes of domination that originate from the same cultural pathology of the “Western World”.

 

 


TIME is NOW: Territorial Integrity of Mother Earth

 

The celebration of the fulfillment of the 13th Baktun of the Maya Calendar on the winter solstice of 2012 has as its measurement of cyclical proportion a fundamental set unit of 20 days which is marked by the Maya Long Count starting on August 13, 3114 BCE.  Known today in Izkaloteka tradition as the Cicitlalmina, the original date has correspondence to the annual appearance of the Perseid Meteor Shower every year in mid-August.  Today, the Tolteka-Izkaloteka continue to celebrate the annual arrival of the cicitlalmina.  The active imagery of this astronomical phenomena symbolically depicts the falling of rain upon the original milpa (cornfield) of the ancestral nations of Anáhuac.

 

With this millennial history and collective consciousness in place and activated, in 2020 the Continental Commission Abya Yala called for the Izcalli Abya Yala as Continental Indigenous Uprising and Emergence to coincide and synchronize with the Spring-Fall equinoxes of that year.

 

The call of the Izcalli Abya Yala of 2020 was to vision, to organize and exercise the Right of Self Determination as Original Nations of Indigenous Peoples acting in Continental Alliance and Confederation in defense of the Territorial Integrity of Mother Earth. Since 2020, the processes of uprising and emergence, evaluation and organizing from local-regional, continental-global scales of incidence by the Indigenous Nations of Abya Yala continues to develop and mature.

 

The Cochabamba Protocols

 

The World Conference on Climate Change and the Rights of Mother Earth in Cochabamba, Bolivia took place in 2010.  The event was attended by some 30,000 people from over 100 countries.

 

After Cochabamba, the conceptual and political disconnect between the rhetoric of the “progressive” and “ecologically sustainable” discourse at the international levels collapsed of its own weight.  It became evident, not for the first time of course, but in today’s time that there was an urgent need to intentionally shift the paradigm of context of the global climate debate beyond the limiting and controlling agendas of the “sovereign state” Westphalian system (AKA the UN system) and move strategically into regeneration of a global set of relationships of INTERDEPENDENCE as Nations of Peoples of Mother Earth.

 

In Cochabamba at the World Conference on Climate Change and the Rights of Mother Earth, these principles were hailed as the Cochabamba Protocols.

Today in 2023, in the wake of the recent failures of the UN systems to competently address the climate crisis impacting the planet and all humanity, the call is now for the invocation of the defense of the Territorial Integrity of Mother Earth as a fundamental and complementary principle and strategic framework in order to interconnect, interrelate and move forward outside of the fractured and competing agendas of the states, and the economic interests of supra-national corporate dominion and exploitation that control and define the terms of the climate change crisis in terms of “development”.


What is in question is the need for the international legal system of the planet to escape the conceptual constraints and the ethical void of the colonial legacy which gave origin to the present international framework, in open violation of the right of self-determination of the Indigenous Peoples, equal to all other peoples.

Such a geopolitical trajectory could provide an effective strategic repositioning of global ecological concerns vis-à-vis the fractured interests of the states and the corresponding geopolitical blocs of power and competition.

A multilateral world that integrated the recognition of Indigenous Nationhood, where the rights and responsibilities of the Original Nations of Indigenous Peoples of Mother Earth are acknowledged and respected could provide a possible alternative to the self-destructive modus operandi of the present international regimes of competition, consumption, and finally the fatal degradation of the biosphere.


Today the Continental Commission Abya Yala reaffirms and now proclaims our mutual commitment to defend and protect the Territorial Integrity of Mother Earth as a fundamental tenet of contemporary International Law which integrates the Right of Self Determination of the Nations of Indigenous Peoples to intervene in the defense of Mother Earth and to take necessary corrective action in exercise of the right of Free, Prior and Informed Consent in defense of their territories and nations.


We further proclaim the fundamental precept of World Water One as the common cultural principle of cognition, collective planetary consciousness, and responsibility in order to empower our efforts of corrective actions to ensure the well-being of all humanity and the future generations.

 

The issue is not about what we want.

 

It is about what we WILL.

This morning at dawn the Calpolli Izkaloteka have allowed the sacred fire of the Nahuacalco which has been sustained all year, to expire and lay in repose for the five days of the Nemontemi.


The sacred Axicalli Gourds of Water have been laid before our  altars in our homes, in our communities, and upon the sacred sites of Mother Earth. Accordingly, here is where and how the essential intentions, prayers, dreams and visions of the Nemontemi will be collected as the Xinachtli (Seed) of memory for the coming generations of all life on Mother Earth.

 

 

Passing through a time of the most extreme threat of war, destruction, ecological devastation and inhumanity, the Calpolli Nahuacalco of Izkalotlan offers once again the simplest of prayers for the well being and protection of all life: Cemanuak - Water of Life: World Water: ONE.

Nuestra Celebración del Año Nuevo Mexica ahora ha entrado en el primer día de la cuenta Nemontemi de 5 días que sirve como paso de recuerdo (pasado y futuro) y regeneración.


Esta mañana, el Calpolli Izkaloteka han permitido que el fuego sagrado de Nahuacalco que se ha sostenido todo el año, expire y descanse durante los cinco días de Nemontemi.
 

A partir de la madruga, las sagradas Jicaras de Agua Axicalli han sido puestas ante nuestros altares en nuestros hogares, en nuestras comunidades y en los lugares sagrados de la Madre Tierra.


Aquí entonces es dónde y cómo se ofrendan las intenciones, oraciones, sueños y visiones esenciales de los Nemontemi serán recogidos como Xinachtli (Semilla) de memoria para las próximas generaciones de toda la vida en la Madre Tierra.


Pasando por la amenaza más extrema de guerra, destrucción, devastación

Aucan Huilcaman: Chilean Constitutional Process and its Permanent Denial of the Mapuche Nation

HISTORIC OPPORTUNITY FOR THE FORMATION OF A “MAPUCHE PROVISIONAL GOVERNMENT UNDER INTERNATIONAL LAW.

The Chilean political class, based in Parliament, has designed and imposed an institutional formula for an apparent participation in the new constitutional process with the Indigenous Peoples and the Mapuche. The apparatus of "reserved seats" has been installed again, subject to a set of conditions that prevent full participation and in complete contravention of the Mapuche right to self-determination and Free, Prior, and Informed Consent. 

 

Only two people such as Julio Marileo and Alihuen Antileo Navarrete, as a candidate for the "Constitutional Council" under the apparatus of "reserved seats", show the absolute and complete lack of interest of the Mapuche People and their organizations for the participation of the process constituent. This singular situation, firstly, sends a very clear message to the Chilean political class that the Mapuche are beginning to disengage from the Chilean State, and secondly, to the candidates of Mapuche origin themselves who, with their participation, are contravening the “higher interest of the Mapuche People”, therefore, both have to evaluate whether to continue or abandon their candidacies, considering that their participation involves the Mapuche People and our collective rights and they do not have a mandate to subordinate the Mapuche Peoples now or in the future to a new version of the domestic constitution of Chile.

 

The Chilean political class that converges in the Chamber of Deputies and Senators, not only continue to act in the "old political doctrine of denial of the Mapuche People and their rights", but also try to omit and ignore the "legal status" that currently available to Indigenous Peoples. This "legal status" comes from international law that has recognized: the "right of self-determination", the "Mapuche Parliaments", the "Territorial Sovereignty", the "Free and Informed Prior Consent", among other relevant rights that constitute the tools policies to decide whether or not to participate in a process that is clear and previously supervised and pre-established in its contents. In this case, we Mapuche have specifically decided not to participate. 

          

                                                                                                               The Chilean political parties have remained in the political and legal doctrine of the past, typical of the 1990s, when international law had not taken such a leap forward as today, where today the bar is very high that, even the proposal constitutional rejected in September 2022, was insufficient, for the rights now acquired internationally.

 
The absolute lack of interest in the participation of the Mapuche People in the Chilean constituent process, also reveals two fundamental issues, one that the votes have been forced acts on the part of the State in the process of Chileanization, domestication and internal colonialism, and on the other hand, on this occasion, the Mapuche People have made the principle and the right to self-determination prevail, just as they did in the era of the "Parliaments", exercising this right by not participating in a constitutional process, openly denialist and colonial that the political parties have designed, through the "reserved seats" that will not help to resolve the controversy between the Chilean State and the Mapuche People. 
 
The bases or "parameters" that the political parties have agreed to for the new constitution, (Article 4) relative to constitutional recognition with Indigenous Peoples, is completely contrary to the right of self-determination, it is minimalism, surpassed by all other political constitutions from Latin America. Its eventual adoption represents a setback, that is, the Mapuche would have to abandon or voluntarily divest themselves of the rights acquired internationally and assume a conduct typical of domestication and colonialism and not resolve the institutional relations between the Chilean State and the Mapuche People under the principle and the right to self-determination.
 

This Chilean constituent process offers the Mapuche People a great and propitious historical opportunity for the formation of a "Mapuche Provisional Government", under the protection of international law, unequivocally established in two international norms, of which I was its co-legislator for two decades. 
 
Each and every one of the people who self-identify as Mapuche are and are challenged to show an institutional responsibility with the present and future of the Mapuche People, in terms of properly using the tools and rights contained in the "legal statute" that establishes the highest right such as self-determination, which grants the political "authority", the "mandate" and the "faculty" to form a "provisional government" in the shortest possible time. Otherwise, the future Mapuche Nation will continue to make political pilgrimages of petition before the future governments of Chile and its institutions. In this context, history has taught us after two centuries of experiences, 142 years after the pacification of Araucanía and more than 30 years after the military dictatorship. 
 
Only an uninformed Mapuche person or one who accepts colonialism and domestication could abandon the rights restored by international law and not take up the historic opportunity for the formation of a "provisional government", although shaking off colonialism is not an overnight event.  In this sense, there is great progress in the elaboration of the "Statute for a Mapuche Government" that has been drawn up at the summit of Cerro Ñielol del Wallmapuche during several consecutive sessions, by those who have adhered to the Mapuche Self-Determination process so far. ..

Proceso Constitucional Chileno y su Negacionismo Permanente con los Mapuche.                                       

HISTORICA OPORTUNIDAD PARA LA FOMACION DE UN “GOBIERNO PROVISIONAL MAPUCHE AL AMPARO DEL DERECHO INTERNACIONAL.

La clase política Chilena radicada en el Parlamento, ha diseñado y ha impuesto una formula institucional para una aparente participación en el nuevo proceso constitucional con los Pueblos Indígenas y con los Mapuche. Se ha instalado nuevamente la figura de los “escaños reservados” sujetos a un conjunto de condiciones que impiden una participación plena y en completa contravención al derecho a la autodeterminación Mapuche y el Consentimiento Previo Libre e informado.   Alihuen Antileo Navarrete, como candidato al “Consejo Constitucional” bajo la figura de “escaños reservados”, pone de manifiesto la absoluta y completa falta de interés del Pueblo Mapuche y sus organizaciones para la participación del proceso constituyente. Esta situación singular, en primer lugar, le envía un mensajes muy claro a la clase política Chilena que, los Mapuche comienzan a desentenderse con el Estado Chileno, en segundo lugar, a los propios candidatos de origen Mapuche que, con su participación están contraviniendo el “interés superior del Pueblo Mapuche”, por lo mismo, ambos tienen que evaluar si continúan o abandonan sus candidaturas, considerando que su participación involucra al Pueblo Mapuche y sus derechos y ellos dos no tienen mandato para dejar amarrado y subordinado constitucionalmente al Pueblo Mapuche y su futuro.

 

La clase política Chilena que converge en la cámara de Diputados y Senadores, no tan solo siguen actuando en la “antigua doctrina política del negacionismo con el Pueblo Mapuche y sus derechos”, sino, además, pretenden omitir y desconocer el “estatuto jurídico” que disponen los Pueblos Indígenas en la actualidad. Cuyo “estatuto jurídico” proviene del derecho internacional que ha reconocido: el “derecho de libre determinación”, los “Parlamentos Mapuche”, la “Soberanía territorial”, el “Consentimiento Previo Libre e informado”, entre otros derechos relevantes que constituyen las herramientas políticas para decidir, si participar o no participar, en un proceso clara y previamente tutelado y preestablecido en sus contenidos. En este caso se ha decidido concretamente a “no participar”.

 


Los partidos políticos Chilenos se han quedado en la doctrina política y jurídica del pasado, propias de la década de 1990, cuando el derecho internacional no había dado un paso tan agigantado como hoy, en donde hoy la vara está muy alta que, incluso la propuesta constitucional rechazada en septiembre 2022, era insuficiente, para los derechos adquiridos internacionalmente.

 

La absoluta falta de interés de participación del Pueblo Mapuche en el proceso constituyente Chileno, además, pone de manifiesto dos cuestiones fundamentales, una que, las votaciones han sido actos forzados de parte del Estado en el proceso de Chilenización, domesticación y colonialismo interno y por otro lado, en esta oportunidad, el Pueblo Mapuche ha hecho prevalecer el principio y el derecho a la libre determinación, igual como lo hicieron en la era de los “Parlamentos”, ejerciendo este derecho en la no participación en un proceso constitucional, abiertamente negacionista y colonial que han diseñado los partidos políticos, mediante los “escaños reservados” que no ayudaran a resolver la controversia del Estado Chileno y el Pueblo Mapuche.

Las bases o "bordes" que han convenido los partidos políticos para la nueva constitución, el numeral 4.- relativo al reconocimiento constitucional con los Pueblos Indígenas, es completamente contrario al derecho de libre determinación, es un minimalismo, superado por todas las constituciones política de América Latina. Su eventual adopción representa un retroceso, es decir, los Mapuche tendrían que abandonar o despojarse voluntariamente de los derechos adquiridos internacionalmente y asumir una conducta propia de la domesticación y el colonialismo y no resolver las relaciones institucionales entre el Estado Chileno y el Pueblo Mapuche bajo el principio y el derecho a la libre determinación. 


Este proceso constituyente Chileno, ofrece al Pueblo Mapuche la gran y propicia oportunidad histórica para la formación de un “Gobierno Provisional Mapuche”, al amparo del derecho internacional, establecido inequívocamente en dos normas internacionales, del cual fui su co-legislador durante dos décadas.

 

Todas y cada una de las personas que se autoidentifican Mapuche, están y estamos interpelados para mostrar una responsabilidad institucional con el presente y el futuro del Pueblo Mapuche, en cuanto a utilizar adecuadamente las herramientas y los derechos contenidos en el “estatuto jurídico” que establece el más alto derecho como es la autodeterminación que, otorga la “autoridad” política,  el “mandato” y la “facultad” para formar un “gobierno provisional” al más breve plazo. De lo contrario, el futuro colectivo Mapuche, será seguir peregrinando ante los futuros gobiernos de Chile y sus instituciones. En este contexto, la historia nos reporta dos siglos de experiencias, 142 años Pos-Pacificación de la Araucanía y más de 30 años pos dictadura militar.

Solo una persona Mapuche desinformada o aquel que acepta el colonialismo y la domesticación podría abandonar los derechos restituidos por parte del derecho internacional y no asumir la oportunidad histórica para la formación de un “gobierno provisorio”, aunque sacudirse del colonialismo no es de la noche a la mañana. En este sentido hay un gran avance en la elaboración del “Estatuto para un Gobierno Mapuche” que se ha redactado en la cima del Cerro Ñielol del Wallmapuche durante varias sesiones consecutivas, de parte de los que han adheridos hasta el momento al proceso de Autodeterminación Mapuche.
