The Mapuche Movement for self-determination, respectfully addresses you, to convey our interest and accompany the following recommendations for presentation at the Round Table based on resolution 47/8 of the UN Human Rights Council on the "Negative consequences of the legacies of colonialism in the enjoyment of human rights", whose Round Table will be held in Geneva, Switzerland, on September 28, 2022.
1.- We fully support resolution 47/8 of the Human Rights Council in stating that, “In the same way Recognizing that the period 2021-2030 has been declared the Fourth International Decade for the Elimination of Colonialism by the General Assembly, and that all Member States, specialized agencies and other organizations of the United Nations system, as well as other governmental and non-governmental organizations, have been invited to actively support and participate in the implementation of the plan of action for the Decade”.
2.- We value the aforementioned resolution by affirming that, “Recognizing with concern that the consequences of colonialism, in all its manifestations, such as economic exploitation, inequalities within and among States, systemic racism, violations of the rights of Indigenous Peoples, contemporary forms of slavery and damage to cultural heritage, have negative consequences on the effective enjoyment of all human rights.”
3.- We underline the various forms that colonialism has taken contained in the resolution that mentions “Recognizing that colonialism has led to racism, racial discrimination, xenophobia and related intolerance, and that African and Afro-descendant people, people Asian and Asian descent and Indigenous Peoples were victims of colonialism and continue to be victims of its consequences”.
4.- The deep concern found in the instrument that, “Expressing deep concern about the violations of the human rights of Indigenous Peoples committed in colonial contexts and highlighting the need for States to adopt all necessary measures to protect the rights and ensure the safety of Indigenous Peoples, especially indigenous women and children, in order to restore truth and justice and hold those responsible to account.”
5.- Bearing in mind that the resolution urgently urges the Member States of the United Nations to “Request the Member States, the competent organs and agencies of the United Nations and other relevant stakeholders to adopt concrete measures to deal with the consequences negative effects of the consequences of colonialism on the enjoyment of human rights”.
We, the Indigenous Peoples, reaffirm that we continue to be the object of colonialism today in multiple forms, taking into account that the systemic nature of colonialism violates the full enjoyment of our human rights.
6.- The aforementioned resolution of the United Nations Human Rights Council urges the Chilean political class to overcome the "denialism of two centuries that has been imposed on the Mapuche People and their rights" and invites dialogue based on the new established standards that are emerging from contemporary international law.
Therefore, we ask that:
Your Foreign Ministry / Ministry of Foreign Affairs send to your diplomatic representation in Geneva and transmit the following recommendations to the Round Table, to be held on September 28, 2022.
We recommend the following:
I.- That a "Second Round Table" be held to continue the dialogue on Colonialism and its effects.
II.- That a Special Rapporteur be appointed, in order to obtain the appropriate inputs and achieve the results within the framework of the "Fourth International Decade for the Elimination of Colonialism by the General Assembly."
III.- That within the framework of the Decade, a Working Group be set up in the context of the Human Rights Council and report to said body.
IV.- That the situation of the Indigenous Peoples be dealt with in the International Committee for Decolonization, based on resolution 1514.
V.- We request that in Chile, a Working Group be constituted following the recommendations of resolution 47/8.
Finally, we hope that our recommendations will be included in the conclusions and recommendations of the “Round Table” in Geneva, Switzerland.
