Muchas gracias señor Presidente.
A partir de la adopción de la Declaración de Naciones Unidas
sobre los Derechos de los Indígenas, todos los Pueblos Indígena son titulares
del derecho a la libre determinación. Este derecho otorga y determina las
facultades para que los Pueblos Indígenas determinen libremente su futuro. En
este sentido el Pueblo Mapuche de Chile ha asumido de manera firme la
implementación del derecho a la libre determinación en toda su forma.
Desde el 2007 en adelante los Mapuche se han propuesto
identificar y trabajar alrededor de las condiciones elementales para el
ejercicio del derecho a la libre determinación y esta condiciones previas
consisten en primer lugar, construir voluntad colectiva como consecuencia
directa de la voluntad individual de cada persona que determina participar de
un proceso de libre determinación. En segundo lugar, disponer de una dotación o
contingente de personas Mapuche con mentalidad y capacidad de gobernantes para
implementar el derecho a la libre determinación, en tercer lugar elaborar y
adoptar un estatuto que determine la forma concreta sobre la instalación de un
gobierno, en cuarto lugar, un sistema de gobierno y finalmente un modelo
económico.
Señor Presidente.
Teniendo en cuenta lo anterior los Mapuche se han propuesto
definitivamente a darle forma el derecho a la libre determinación contenida en
la Declaración de Naciones Unidas sobre los derechos de los Pueblos Indígenas,
en este sentido se ha determinado convocar a una Asamblea Constituyente
Mapuche.
Esta Asamblea Constituyente Mapuche tendrá dos grandes
objetivos esenciales la elaboración y adopción de un estatuto y en segundo
lugar establecer un cronograma para la conformación de un gobierno Mapuche al
amparo del derecho internacional y en base al artículo n.- 3 de la Declaración.
Señor Presidente.
En vista que la Asamblea Constituyente Mapuche será una
forma concreta de la libre determinación, pedimos que el mecanismo de experto
concurra a Chile a la ciudad de Temuco
en el mes de octubre 2016 y verifique la realización de dicho evento propio y
característico de la libre determinación.
Señor Presidente.
En esta oportunidad y en el desarrollo de la 9 sesión del
Mecanismo de expertos, quisiéramos pedirle formalmente al gobierno de Chile a
que apoye decididamente la realización de la Asamblea Constituyente Mapuche
como muestra sincera y de buena fe sobre sus compromisos con el derecho internacional y especialmente
con los preceptos contenidos en la Declaración.
Del mismo modo quisiéramos escuchar una reacción de parte
del gobierno de Chile, considerando que un dialogo fructifero alrededor de
principios y directrices de los derechos humanos requiere de actuaciones
públicas en donde se ponga de manifiesto la voluntad sobre determinados
derechos y muy especialmente sobre el derecho a la libre determinación
indígena.
Finalmente invito a todos los delegados indígenas
interesados en el derecho a libre determinación a que concurran al territorio
Mapuche y observen la forma y alcance que adquiere el derecho a la libre
determinación.

INDIGENOUS PEOPLES

Thank you very much Mr. President,
Since the adoption of the UN Declaration on the Rights of
Indigenous, all Indigenous Peoples are recognized as entitled with the right to
self-determination. This right grants and determines the power of authority to
indigenous peoples in order to freely determine their future. In this sense,
the Mapuche Nation of Chile has firmly assumed the power to implement the right
to self-determination in all its forms.
From 2007 onwards the Mapuche Nation has proposed to
identify and work towards establishing the elementary conditions for exercising
the right to self-determination and these preconditions consist firstly, to build
the collective will as a direct consequence of the individual will of each
person who determines to participate in a process of Mapuche self-determination.
Secondly, to provide for a contingent of Mapuche people prepared with the mentality
and abilities of self-government in order to implement the right to Mapuche self-determination,
and thirdly to develop and adopt the statutes that determine in concrete form
the installation of Mapuche self-government, and fourthly to institute an actual
system of government, and finally the establishment of an economic model.
Mr. President,
Given the above the Mapuche Nation has proposed definitely to
give form to the right to self-determination referenced in the UN Declaration
on the Rights of Indigenous Peoples and in this regard has determined to
convene a Constituent Assembly of the Mapuche Nation.
The Constituent Assembly of the Mapuche Nation shall have
two essential objectives: the development and adoption of a statute and
secondly to establish a timetable for the conformation of a Mapuche government
under the protection of international law and based on article 3 of the
Declaration.
Mr. President,
Given that the Constituent Assembly Mapuche would be a
concrete expression of self-determination, we ask that the UN Expert Mechanism
on Indigenous Rights attend the constituent assembly in the city of Temuco,
Chile in October 2016 and thus verify the implementation of this unique and
characteristic event of Mapuche self-determination.
Mr. President,
On this occasion and in the development of this 9th session
of the Expert Mechanism, we would also formally ask the government of Chile to
support strongly the realization of the Constituent Mapuche Assembly as sincere
example in good faith in fulfillment of its commitments under international law
and especially with the precepts contained in the Declaration. Likewise, we
would like to hear a reaction from the government of Chile, considering that a
fruitful dialogue regarding the principles and guidelines of human rights
requires public expression where the public will is manifested and determined, especially
regarding the right to indigenous self-determination.
Finally, I invite all indigenous delegates interested in the
right to Indigenous self-determination to join us in the Mapuche territory and
observe the shape and scope which has now acquired the right to Indigenous Self
Determination.
