Encuentro de los
Pueblos de Abya Yala Hacia la Construcción de una América Plurinacional
Estimado hermano Evo Morales Ayma. Agradezco la invitación que me ha extendido para participar del Gran Encuentro de los Pueblos de Abya Yala Hacia la Construcción de una América Plurinacional, ha realizarse los días 17 al 19 de diciembre de 2020, en Cochabamba, Bolivia.
Asimismo, le hago
llegar a todos los participantes mis puntos de vista y recomendaciones a ese
magno evento.
1.- Resulta completamente oportuno ratificar de manera plena el derecho a la libre determinación de los Pueblos Indígenas, tal como lo ha establecido el derecho internacional y evitar cualquier disminución o su domesticación, considerando que es un derecho y una herramienta para determinar el presente y el futuro de los Pueblos Indígenas.
2.- Establecer y definir una alianza estratégica geopolítica entre los Pueblos Indígenas que nos permita interactuar en el mundo multilateral y especialmente ante las readecuaciones internacionales de los intereses del capital y el modelo económico internacional representada en la pugna entre el occidente y oriente.
3.- Exigir como condición previa para alcanzar la Paz, Investigación y Esclarecimiento de los hechos que constituyeron el “Crimen de Genocidio” que se cometió con los Pueblos Indígenas en la relación colonial hispana y con los Estados Nacionales latinoamericanos y que permanecen en completa impunidad, como es el caso del Estado Chileno y el Pueblo Mapuche. Crimen de Lesa Humanidad que interpelan a conocer la verdad, reparar el daño causado, hacer justicia con los Pueblos Indígenas y de esta manera en el Continente encausarnos hacia una Paz firme y Duradera.
4.- Revisar la eficacia de la participación de los Pueblos Indígenas en los Procesos constitucionales tanto, en la Reformas y Nuevas Constituciones Políticas, a raíz de 50 años de vigencia de estos hechos, en donde se observa como resultado el establecimiento de una relación institucional de domesticación y colonialismo Estatal y muy especialmente examinar la figura del “Estado Plurinacional” y su compatibilidad con el derecho a la libre determinación de los Pueblos Indígenas.
5.- Exigir inequívocamente la anulación y revocación de la “Doctrina del Descubrimiento” a los organismos institucionales que actuaron históricamente al margen del derecho, auto-otorgándose prerogativas que no tenían y al mismo tiempo se haga cumplir la disposición del derecho internacional que establece que las tierras, territorios y sus recursos que fueron tomados, ocupados y confiscados sin su consentimiento de los PP.II debe ser Restituido, Reparado e indemnizado de manera justa imparcial y equitativa.
6.- Exigir investigación y sanción penal internacional por Covid-19 se haya creado por los laboratorios o haya sido un descuido allí en Wuhan China. Además, asumir un compromiso para regular las actividades de la ingeniería genética, la Farmacéutica y la Biotecnología y adoptar nuevas normas internacionales que cautelen y salvaguarden la salud y el bienestar de la humanidad.
7.- Ante amenazas al cambio climático, reafirmar nuestra defensa a la tierra, la biodiversidad, los recursos genéticos y nuestras culturas milenarias se convierta en la herramienta elemental para mitigar las consecuencias del Cambio Climático y de parte de los Estados y gobiernos de turnos cumplan las normativas y sus obligaciones internacionales que han convenidos.

Arquitecturas de los Estados y la Integridad Territorial de
la Madre Tierra
Las arquitecturas de los Estados y sus Acuerdos son insuficientes, incompetentes y no representativos de nuestra voluntad política y nuestra autodeterminación como pueblos de la Madre Tierra para abordar las causas sistémicas del cambio climático con el enfoque integral y equitativo necesario para evitar el colapso de ecosistemas y la TERRACIDIA.
Como Pueblos de la Madre Tierra, colectivamente determinamos
a regenerar las relaciones entre nosotros mismos dentro de un clima cultural de
Respeto Mutuo, la Inclusión, la Complementariedad y la Libre Determinación más
allá de las limitaciones actuales de los sistemas internacionales de la
soberanía de los Estados y en la responsabilidad para el bienestar de la las
generaciones futuras;

Encounter of
the Peoples of Abya Yala Towards the Construction of a Pluri-national America

Dear brother Evo Morales Ayma. I am grateful for the invitation that you have extended to me to participate in the Great Encounter of the Peoples of Abya Yala Towards the Construction of a Plurinational America, which will be held from December 17 to 19, 2020, in Cochabamba, Bolivia.
At this time I will not attend personally, because we are immersed in the
Pandemic that affects the World and the Indigenous Peoples in Wallmapuche [Chile]
where we are preparing our international defense initiative to protect our
internationally acquired rights as Indigenous Peoples against the new forms of
domestication and colonialism. A political scheme is being promoted that intends
to impose itself through the mechanism of Reserved Indigenous Seats in the federal
congress with the appearance of “participation” of the Indigenous Peoples.
Likewise, I send all the participants my views and recommendations to this
great event.
1. It is a completely opportune moment to fully ratify the right to Self-Determination of Indigenous Peoples, as established by international law and to deny any attempt of decrease or domestication, considering that the right of Self-Determination of Indigenous Peoples it is an inherent human right and a tool to determine the present and the future of Indigenous Peoples.
2. Establish and define a geopolitical strategic alliance between Indigenous Peoples that allows us to interact in the multilateral world and especially in the face of international readjustments of the interests of capital and the international economic model represented in the present struggle between the West and the East.
3. To demand, as a precondition for achieving Peace, Investigation and Clarification of the facts that constituted the “Crime of Genocide” that was committed against the Indigenous Peoples during the Hispanic colonial relationship and with the successor Latin American National States and that remain in complicit in complete impunity, as is the case of the Chilean State and the Mapuche People. These Crimes against Humanity challenge us to know the truth, repair the damage caused, do justice to the Indigenous Peoples and thus at the continental level lead us all towards a firm and Lasting Peace.
4. Review the effectiveness of the participation of Indigenous Peoples in the constitutional processes of the states, both in the Reforms and New Political Constitutions, as a result of 50 years of experience in these events, where the establishment of an institutional relationship is observed as a result of State Domestication and colonialism and, especially, examine the political configuration of the “Pluri-national State” and its compatibility with the right to self-determination of Indigenous Peoples.
5. Unambiguously demand the annulment
and revocation of the "Doctrine of Discovery" to the
institutional political entities that historically have acted outside the law,
granting themselves prerogatives that they did not justly possess, while at the
same time enforcing the provisions of contemporary international law that
establishes that the lands, territories and the resources of the Original
Nations of Indigenous Peoples that were taken, occupied and confiscated
without their consent must be restored, repaired and compensated in a just,
impartial and equitable manner.
6. Demand investigation and
international criminal sanction for the spread and governmental negligence
related to the Covid-19 pandemic, whether the virus was created in laboratories
or there was been a break in public safety protocols at the source in Wuhan
China. In addition, assume a commitment to regulate the activities of genetic
engineering, Pharmaceutical and Biotechnology and adopt new international
standards that safeguard and safeguard the health and well-being of all humanity.
7. Faced with threats to climate change, as Indigenous Peoples the reaffirming of our defense of the Mother Earth, biodiversity, genetic resources and our millenary cultures becomes the elementary tool to mitigate the consequences of Climate Change, which on the part of the States and governments they must in turn comply the regulations and their international obligations that they have agreed upon.

Architectures of the States and the Territorial Integrity of Mother Earth
In furtherance of which we affirm and now proclaim our mutual commitment to defend and protect the Territorial Integrity of Mother Earth as a fundamental tenet of International Law which integrates the Right of Self Determination of the Nations of Indigenous Peoples to intervene in the defense of Mother Earth and to take necessary corrective action in exercise of the right of Free, Prior and Informed Consent in defense of their territories and nations.
